TOWN OF STEPHENSON MARINETTE COUNTY TOWN HALL
PUBLIC HEARINGS – 4 VARIANCES
May 14, 2025
The first hearing was called to order at 6:30 pm by Chairman Kudick. Clerk Olson stated all variance hearing notices were posted in the Peshtigo Times as a Class 1 notice. She further stated that all certified copies were sent and cards returned from all neighbors. There were 19 persons present.
The first hearing was for a petition filed by David Samsa for property located at W9692 Schroeder Lane, Crivitz, WI, in the Town of Stephenson, Marinette County, WI. He is requesting to build an addition to his present home and it will only be 45’ from the center line if he matches it with his present front and he has a deck on the back so he can’t build off that. Supervisor McCabe asked if Mr. Samsa had a current survey done and the answer was, he did not. Supervisor McCabe also asked to go through the application so the Board would know if it is truly a hardship or just a want. He feels the Board needs to know that to protect future land owners. Jane Meissner stated that when the road was redone, it took some of Mr. Samsa’s front yard because it is not centered in the ROW. She also stated that a survey was never required for a variance before. She just went by the GPS. Supervisor McCabe felt it was very important to know where the true lot lines are to protect future buyers of the property. Attorney Coggins stated that if the building for which the variance is requested is gone, the variance is no longer in effect. Supervisor McCabe explained more on how the County handles variances and stated he understands that there would be more cost to getting a survey and it would be a delay, however, he feels it is in the best interest of everyone. There were no further questions, so Chairman Kudick closed the hearing at 6:45 pm.
The hearing for a request for a variance by Dan Holzer for property located at W11356 County Hwy X in Crivitz was called to order at 6:45 pm. He is requesting to use his existing driveway for a new garage. It will only be 3 feet of the east lot line. There were no neighbors against this. It would make it safer to get on to County X, rather than backing in to traffic, if he can build there and move the driveway over. There were few questions for Mr. Holzer. Hearing closed at 6:53 pm.
The variance hearing for James Rasmussen was called to order at 6:53 pm. He is requesting to build a new garage in the same spot at N11226 Wagner Lane as the old one. It is closer to the road than any of the other properties. Moving it would impede on the drain field. Supervisor Belanger asked if the runoff would affect the neighbors. Mr. Rasmussen stated he is going to angle the garage to keep the run off away. Jane stated that he would have to go to the County for shoreland zoning, but not for a variance. No further questions or concerns so the hearing was closed at 7:02 pm.
The Anthony Swanningson variance request to build a dwelling closer to the road because of wetlands, for property at N7897 Louisa Road, was called to order at 7:02 pm. Mr. Swanningson stated he is having the property surveyed, so the footage on the application is just a ball park figure. Supervisor McCabe asked if he could move the building back. Mr. Swanningson stated he will move it back as much as possible. He did present the Board with a Delineation report from the DNR. No further questions so Chairman Kudick closed the hearing at 7:04 pm.
